Terms of Service

A very warm welcome to Kallos — Golden Hour. We are delighted to have you here and we wish for your experience in our boutique to be as welcoming as your favourite morning ritual. These Terms of Service have been carefully prepared to ensure that our relationship is built upon transparency and mutual respect. They serve as a guide to protect both you and our curated collection, ensuring that every detail of your journey occurs with the security and sophistication you deserve. Should any questions arise whilst reading, please do not hesitate to write to us at support@kallosgoldenhour.co.uk.

1. Contracting Parties and Acceptance of Terms

This agreement is established between Kallos — Golden Hour, hereinafter referred to as the "Company", and the individual or entity accessing the website, hereinafter referred to as the "Customer". By browsing our boutique or completing a purchase, you acknowledge that you have read, understood, and agreed to be bound by these Terms. This acceptance forms a legally binding contract under the laws of England and Wales. The rationale behind this clause is to establish a clear legal framework for all digital interactions, ensuring that both parties operate under a unified set of expectations.

Failure to agree with any part of these terms necessitates that the Customer ceases use of the website immediately. Continued use constitutes an express waiver of any claims regarding the lack of knowledge of these rules. We reserve the right to update these terms at any time to reflect changes in legislation or our business model. It is the Customer's responsibility to review this page periodically. The legal basis for this requirement is found in the Electronic Commerce (EC Directive) Regulations 2002, which governs the formation of online contracts.

Breach of this clause, such as the unauthorised use of the platform or the provision of false information during registration, will result in the immediate termination of the Customer's account and potential legal action. We maintain a zero-tolerance policy towards fraudulent activities to preserve the integrity of our community and the safety of our sophisticated clientele.

2. Order Processing and Purchase Offer

When you place an order through our basket, you are making an offer to purchase the selected items. This offer is subject to our acceptance and stock availability. We will send an initial acknowledgement email, but this does not constitute a final acceptance of the order. The contract of sale is only concluded when we dispatch the parcel and send a confirmation of dispatch. This procedure is designed to prevent errors in stock levels and to ensure that every item meets our high quality standards before being sent to your home.

The legal rationale for this "invitation to treat" model is to protect the Company from technical glitches that might display incorrect stock or pricing. Under the Consumer Rights Act 2015 (as amended), we reserve the right to decline any order without providing a specific reason, although we will always endeavour to communicate clearly with you. If we cannot fulfil an order after payment has been taken, a full refund will be issued to your original payment method within 3 to 5 working days.

Any attempt to manipulate the ordering system or exploit technical vulnerabilities will be considered a material breach of contract. In such instances, the Company reserves the right to cancel all pending orders and blacklist the associated IP address. We value the trust you place in us and work tirelessly to ensure our digital shopfront remains a reliable and elegant space for your shopping.

3. Pricing, Taxes, and Payment Methods

All prices displayed on our website are in Pounds Sterling (£) and are inclusive of VAT where applicable, unless stated otherwise. We strive for absolute precision in our pricing; however, should a manifest error occur where an item is priced significantly below its market value due to a technical fault, we are not obliged to honour that price. The rationale is to maintain a fair trading environment and prevent the exploitation of clerical errors. We will contact you to offer the choice of proceeding at the correct price or cancelling the order.

Payments must be made through the secure gateways provided at the checkout, such as credit/debit cards or other approved digital wallets. By providing your payment details, you represent that you are authorised to use the chosen method. The legal basis for our payment processing complies with the Payment Services Regulations 2017, ensuring your financial data is handled with the utmost security and encryption. We do not store sensitive card information on our own servers.

If a payment is declined by your bank or card issuer, we cannot be held responsible for any delay or non-delivery of your parcel. The consequence of a failed payment is the automatic suspension of the order processing. We recommend ensuring that your billing address matches the records held by your bank to avoid any unnecessary interruptions to your Golden Hour experience.

4. Right of Withdrawal and Cancellation

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your items without giving any reason. This "cooling-off period" is a fundamental right for UK consumers, allowing you to inspect the quality of our curation in the comfort of your home. The rationale is to bridge the gap between digital browsing and physical touch, ensuring you are entirely satisfied with your choice.

To exercise this right, you must inform us of your decision via a clear statement sent to support@kallosgoldenhour.co.uk. Once notified, you have a further 14 days to return the items to us. The items must be in their original, unused condition and in their original packaging. We believe that true sophistication lies in the details, and we ask that you treat the products with the same care we used when preparing them for you.

Failure to return the items within the statutory timeframe or returning them in a diminished state (beyond what is necessary to establish the nature and characteristics of the goods) may result in a deduction from your refund. This ensures that our boutique can continue to offer pristine products to all our customers. Refunds will be processed within 14 days of us receiving the returned goods.

5. Statutory Warranty and Defective Products

Every product in our collection is covered by the Consumer Rights Act 2015, which mandates that goods must be of satisfactory quality, fit for purpose, and as described. If you receive an item that possesses a latent defect—a fault that was not apparent upon initial inspection—you are entitled to a repair, replacement, or refund. Our rationale is to guarantee that your investment in the Kallos lifestyle is protected against manufacturing failures that are beyond your control.

If a fault is discovered within the first 30 days of delivery, you may exercise your "short-term right to reject" for a full refund. Beyond 30 days, but within six months, we will first offer to repair or replace the item. If this is not possible or unsuccessful, you may then claim a refund. We kindly ask for photographic or video evidence of the defect to help us improve our quality control and liaise with our artisans and carriers.

This warranty does not cover damage caused by accidental breakage, neglect, misuse, or normal wear and tear. Attempting to repair a defective item yourself or through a third party before contacting us will void your right to a claim under this clause. We are committed to resolving any issues swiftly and with the grace that defines our brand.

6. Intellectual Property and Copyright

All content included on this website, such as text, graphics, logos, images, and digital downloads, is the property of Kallos — Golden Hour or its content suppliers and is protected by UK and international copyright laws. The unique aesthetic of our brand is the result of extensive creative labour and curation. The rationale for this clause is to protect our brand identity and prevent the unauthorised commercial exploitation of our creative assets.

Customers are granted a limited, non-exclusive licence to access and make personal use of this site. You may not download, modify, or use any portion of the site for commercial purposes without our express written consent. This includes the prohibition of using any data mining, robots, or similar data gathering tools. We take the protection of our intellectual property very seriously to ensure the Kallos experience remains exclusive and authentic.

Any infringement of our copyright or trademarks will result in immediate legal notice and potential litigation under the Copyright, Designs and Patents Act 1988. We actively monitor the digital landscape for unauthorised use of our imagery and descriptions. Respecting our creative work allows us to continue bringing beauty and sophistication to your daily life.

7. Limitation of Liability and Website Use

While we strive to ensure that our website is always available and error-free, we cannot guarantee uninterrupted access. The Company shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or the purchase of our products. This includes, but is not limited to, loss of profits, data, or business reputation. The rationale is to limit our legal exposure to events beyond our reasonable control, such as internet outages or third-party service failures.

Nothing in these terms seeks to exclude or limit our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as required by the Unfair Contract Terms Act 1977. Our total liability to you for any loss arising under or in connection with these terms shall be limited to the total price of the items ordered. This ensures a balanced and fair distribution of risk between the boutique and the consumer.

The Customer agrees to indemnify and hold Kallos — Golden Hour harmless from any claims or demands made by any third party due to your breach of these Terms or your violation of any law. Using the site in a manner that causes damage or impairment to its functionality is strictly prohibited and will lead to a permanent ban from our services.

8. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales. This provides a stable and well-understood legal basis for our operations. The rationale is to ensure that any disputes are handled in a jurisdiction that offers robust protections for both consumers and businesses, maintaining the high standards of British commerce.

In the event of a disagreement, we encourage you to contact us directly at support@kallosgoldenhour.co.uk so that we may reach an amicable solution. If we are unable to resolve the matter, you may seek recourse through Alternative Dispute Resolution (ADR) providers or the Online Dispute Resolution platform. This approach is designed to be more cost-effective and less stressful than traditional litigation, reflecting our commitment to a harmonious relationship with our clients.

Should ADR fail, any legal proceedings shall be brought before the courts of England and Wales. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. This "severability" ensures that the core of our agreement remains intact even if a specific detail requires adjustment.
